Quick answer: In Calgary, a legal basement suite is one listed on the City’s Secondary Suite Registry: it has the right permits, passed City inspections and has a City sticker. Before you buy, search the address on the registry at secondarysuites.calgary.ca. Since August 4, 2026, basement suites are a permitted use, which means a suite that meets zoning, building, fire and safety rules is approved without a neighbour review. Backyard suites are still discretionary.

“Does it have a legal suite?” is one of the first questions my buyers ask, especially families who want help with the mortgage or room for parents. A suite with a separate entrance and a kitchen is not automatically legal. Here is how to tell the difference and why it matters, based on City of Calgary information as of October 2026. I am a REALTOR®, not a building inspector, so always confirm with the City for a specific property.

What makes a basement suite legal in Calgary?

The City defines a secondary suite as a second home inside a house, with its own bathroom, cooking area and sleeping area, and an entrance that does not go through the main home. To be legal, the owner must get the required permits, pass City inspections and meet the building code, fire safety rules and the Land Use Bylaw. Approved suites go on the public Secondary Suite Registry and get a numbered City sticker, usually visible inside the suite.

The safety items are the big ones: interconnected smoke and carbon monoxide alarms, fire separation between the units, a bedroom window big enough to escape through, and enough ceiling height. A suite that has never been permitted may fall short on several of these.

What changed in 2026?

  • The 2024 citywide rezoning was repealed as of August 4, 2026, and most properties went back to their earlier land use district. See my zoning page if you are unsure what yours is now.
  • Basement suites became a permitted use on the same date. If a suite meets zoning, building, fire and safety requirements, it is approved without the old discretionary review where neighbours could object.
  • Backyard and laneway suites remain discretionary, so those still go through a more detailed review.

What does “not city-approved” mean for a buyer?

  • Safety: nobody has checked it against the code, and you would be responsible if a tenant is hurt.
  • Insurance: tell your insurer about the suite and any tenants; some policies treat an undeclared rental very differently.
  • Mortgage: lenders decide whether, and how much, rental income from a suite can help you qualify. Ask your lender before you write an offer.
  • Enforcement: if the City is told about an unregistered suite, the owner may have to bring it up to standard or remove it.

How do I check a suite before I buy?

  • Search the address on the City’s Secondary Suite Registry map at secondarysuites.calgary.ca. If it is not there, it is not registered.
  • Look for the City sticker inside the suite during the showing.
  • Ask for the permits and inspection records, and make your offer conditional on reviewing them.
  • Get a home inspection and ask the inspector to point out obvious suite safety gaps.

Can I legalize a suite after I buy?

Often, yes. You go through the City’s registration process: permits (typically a building permit plus electrical and other trade permits), any upgrades the code requires, and City inspections. The cost depends on what needs fixing, such as windows, fire separation or alarms, so get a contractor’s quote before you firm up. The City’s Secondary Suite Incentive Program has helped thousands of owners register suites; check calgary.ca/suites for the current eligibility and any fee relief.

Frequently asked questions

How do I know if a basement suite is legal in Calgary?

Search the address on the City of Calgary's Secondary Suite Registry at secondarysuites.calgary.ca and look for the City sticker in the suite. If the address is not on the registry, the suite is not registered.

Are basement suites allowed everywhere in Calgary after the rezoning repeal?

Since August 4, 2026, basement suites are a permitted use: a suite that meets zoning, building, fire and safety requirements is approved without discretionary review. Confirm your property's district with the City.

Can I buy a house with a suite that is not city-approved?

Yes, but nobody has checked its safety, insurance and mortgage treatment can differ, and the owner may have to upgrade or remove it. Many buyers plan and budget to legalize it.

What permits does a legal suite need in Calgary?

Typically a building permit plus electrical and other trade permits, followed by City inspections. A development permit is only needed in some cases.
